This afternoon, the High Court found against Paul Murphy TD and Pa Daly TD in their actions over Super-Junior Ministers.
Deputy Murphy's High Court action sought a declaration by the High Court that the attendance of ‘Super Junior’ Ministers at Cabinet breaches the provisions of the Constitution which limits the number of Ministers to 15 and which provides that the Cabinet shall act confidentially and collectively.

“I want to thank the Court and my legal team for their work and consideration of this crucial matter.
“I took this action to seek to challenge the participation of ‘Super Junior’ Ministers in Cabinet meetings. This is being used by the current government as a political stroke to facilitate the Lowry group. The essential question is whether the government can ‘get around’ the Constitution, as Leo Varadkar put it, in order to share the spoils of power.
“This decision can be appealed to the Supreme Court. I will be taking time over Christmas to consider the 161 page judgement. I will be meeting with my legal team in the New Year to consider our next steps.”
